Regulation – Terms and Conditions of Atelier Griffin & Cole
Article 1 – Definitions
In these regulations, “Cooling-off period” means the period within which the consumer may exercise the right of withdrawal; “Consumer” means the natural person who acts for purposes not related to professional or business activities and who concludes a distance contract with the entrepreneur; “Ongoing contract” means the distance contract relating to a series of products or services with obligations spread over time; “Right of withdrawal” means the consumer’s option to withdraw from the distance contract within the cooling-off period; “Entrepreneur” means the natural or legal person who offers products or services remotely to consumers; “Distance contract” means the contract concluded between entrepreneur and consumer by means of remote communication tools; finally, “CESOP” means the Central Electronic System of Payment information established by the EU to monitor payment service providers.

Article 3 – Scope of Application
These regulations apply to every offer and every distance contract concluded between Atelier Griffin & Cole and the consumer. Before the conclusion of the contract, the regulations will be made available in electronic form.
Article 4 – Offer
The offers of Atelier Griffin & Cole are non-binding, may be modified at any time, and clearly indicate the total cost, including shipping costs, duties, and any additional charges applied by the carrier.
Article 5 – Conclusion of the Contract
The contract is perfected at the moment the consumer accepts the offer and meets the stated conditions, and the entrepreneur confirms such acceptance via e-mail.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within fourteen days of receiving the product, without penalty. Return costs are borne by the consumer.
Article 7 – Refund of Amounts
Atelier Griffin & Cole refunds all sums received within fourteen days of withdrawal, provided the product is returned intact.
Article 8 – Customs Duties and VAT
The customer is responsible for the payment of any customs duties, taxes, and charges related to importation into the destination country. Atelier Griffin & Cole provides the necessary shipping documentation but does not guarantee compliance with local import regulations.
Article 9 – Compliance with CESOP
From 2024, payment service providers record transaction data in the CESOP system in accordance with EU regulations. Atelier Griffin & Cole complies with these obligations.
Article 10 – Compliance and Warranty
Atelier Griffin & Cole guarantees that the products sold comply with the contract and legal provisions. Any claims for defects must be submitted in writing within fourteen days of discovering the defect; products must be returned intact and properly packaged.
Article 11 – Shipping
Orders are fulfilled within thirty days, unless otherwise agreed between the parties. In case of delay, Atelier Griffin & Cole will inform the consumer within fourteen days of the order date. Shipments are made under EXW conditions (customer as importer); therefore, any customs delays are not attributable to the entrepreneur. The customer’s failure to fulfill customs obligations does not justify cancellation or refund of the order.
Article 12 – Complaint Procedure
Complaints must be submitted in writing within seven days of discovering the problem; Atelier Griffin & Cole responds within fourteen days, communicating any additional timeframes if necessary.
Article 13 – Governing Law and Jurisdiction
These regulations are governed by Dutch law. Disputes will preferably be resolved amicably and, failing that, before the competent court in the Netherlands.
